Trial Level:
United States v. Richard Smith; U.S District Court for the Virgin Islands, Criminal No. 2018-26. Secured a judgment of acquittal for client charged with “Seaman’s Manslaughter” for violating 18 U.S.C. § 1115. In a rare move, the trial court dismissed the case after agreeing with the defense that the United States had failed to produce sufficient evidence against Captain Smith for the case to go to the jury.
United States v. Gerard Castor, et al.; U.S. District Court for the Virgin Islands, Criminal No. 2015-31. Obtained acquittals for client charged with federal program bribery, conspiracy and honest services wire fraud. Client was charged with bribery related to a $20million government construction contract. Case was prosecuted by the Public Integrity Unit of the U.S. Department of Justice in Washington, D.C.
People of the Virgin Islands v. David Stevens J.R., Superior Court of the Virgin Islands, Criminal Case No. 2012-CR-504. Obtained not guilty verdict for police officer charged with manslaughter for shooting which occurred in the line of duty.
Mark Vitalis v. Sun Constructors, Inc., et al.; U.S. District Court for the Virgin Islands, Civil No. 2005-101. Obtained complete defense verdict in race/national origin workplace discrimination claim (Title VII; § 1981 action). Trial was conducted in what is considered one of the most “plaintiff friendly” jurisdictions in the United States.
People of the Virgin Islands v. Shandale Francis, Superior Court of the Virgin Islands, Criminal Case No. 2009-CR-077. Obtained acquittal of client charged with aggravated rape and armed robbery.
People of the Virgin Islands v. Charmaine Clarke; Superior Court of the Virgin Islands, Criminal Case No. 2008-CR-371. Obtained judgment of acquittal on behalf of client charged with first degree murder.
People of the Virgin Islands v. Steven Baxter, Superior Court of the Virgin Islands, Criminal Case No. 2006-CR-102. Jury returned a verdict of “not guilty” for client charged with first degree murder.
People of the Virgin Islands v. William P. Shea, Superior Court of the Virgin Islands, Criminal Case No. 2014-CR-014. Obtained acquittal for client charged with domestic violence, assault, and disturbing the peace, based on claim of self defense.

Kwame Allen v. HOVENSA, LLC, 2013 WL 3976835 (V.I. 2013) (argued). The Virgin Islands Supreme Court upheld an arbitration award finding no liability against refinery operator accused of negligence.
Vitalis v. Sun Constructors, Inc., 2012 WL 1950405 (3rd Cir. 2012) (argued). Third Circuit affirmed complete defense verdict in Title VII race/national origin discrimination case.
People of the Virgin Islands v. Charmaine Clarke, 2011 WL 2150103 (V.I. 2011) (argued). Virgin Islands Supreme Court upheld trial court’s dismissal of conviction for aiding and abetting possession of a firearm during a crime of violence (murder).
Frett-Smith v. Vanterpool, 511 F.3d 396 (3d Cir. 2008) (argued). Third Circuit affirmed outright dismissal of case where plaintiff had obtained a $1,000,000+ verdict against construction company for negligent installation of lighting fixtures in a high school.
United States v. Silveus, 542 F.3d 993 (3d Cir. 2008) (argued). Obtained partial reversal of convictions for client accused of harboring an illegal alien.
Woods v. Virgin Islands, 274 Fed. Appx. 191 (3d Cir. 2008) (argued). Obtained reversal of a judgment of conviction for client convicted of third degree assault and assault with a deadly weapon.
Virgin Islands v. Suarez, 242 Fed. Appx. 845 (3d Cir. 2007) (argued). Third Circuit granted reversal of client’s conviction for first degree rape.
